Frequently Asked Questions
|
|
|
-
Is my donation tax deductible?
All auto donations donated to charitable organizations granted tax exemption
under section 501(c)(3) of the Internal Revenue Code are tax deductible.
Just because an organization is a non-profit organization does not mean that it
has
been granted a tax exemption under section 501(c)(3) of the Internal Revenue
Code.
Ask to see the organization's determination letter from the IRS.

-
Will my vehicle donation provide me with a tax benefit?
If currently you are not itemizing your deductions on your State and Federal
tax returns,
your accountant will be able to tell you if making a car donation would justify
switching to itemizing your yearly deductions and using the longer form.
-
What proof do I need for my deduction?
You will need a receipt from National Airedale Rescue, Inc., verifying the
date, the year,
make and model of your vehicle donation.
-
How is the value determined?
The IRS requires that the donor use the "fair market value"
as a tax deduction.
The
Kelly Blue Book
and the
NADA Guides
may be used as helpful references in determining the Fair Market Value
of your vehicle.
We suggest you review IRS Publication 526 which sets forth the manner in
which the IRS requires you to determine the value of your donated property.

Not all car donation programs are the same.
IRS
Publication 4302
identifies four types of car donation programs. Three of them should not affect a charity's exempt status or the donor's ability to deduct the value of the gift:
- The charity uses the vehicles or distributes them to the needy.
- The charity sells the vehicles and uses the profits to fund its charitable programs.
- The charity hires a for-profit agent to operate the car donation program.
In such cases, the IRS states, "The charity and the for-profit entity must establish an agency relationship that is valid under the applicable state law." The for-profit organization must be acting as the charity's agent, and the charity must have oversight over the actions the agent takes on its behalf.
- The fourth type of program is the one that can get both charities and donors in trouble:
The charity allows a for-profit entity to use its name to solicit car donations, receives a fee or percentage from the sales, but has no control over the for-profit organization's activities.
Contributions to this kind of vehicle donation program are not deductible, even if the nonprofit uses the money it receives to fund charitable activities.
Because the charity has not hired the for-profit entity as its agent and has no control over how the program is carried out, the IRS regards the car donations as contributions to the for-profit organization, not the nonprofit. "A charity," the IRS warns, "cannot license its right to receive tax-deductible contributions." Both the charity and the for-profit entity can be penalized if they mislead donors about the deductibility of their contributions through this kind of program.
Car Program LLC has been advised by legal counsel that our Agreement is within the third example.

About the Photos on this Page:
Airedale Stevie Barrett gave us kind permission to use these photos. The Airedales pulling the sleigh are Stevie along with rescues Katie, Cinnamon, Teddy.
Here's Stevie's explanation of the photo of the ambulance:
Auntie Janet, a friend of ours from whom we got Tigger (that snotty
little white doggie), used to have a significant other who collected
rather unusual things. One of those things was an old ambulance. One
autumn day a few years back I got to go to Auntie Janet's house along
with Barnaby and Boomer. We getted our picshurs taken in the ambulance.
It was kinda dark that day and not too many picshurs turned out.
That's Barnaby hanging out of the driver's window. Boomer
and I were in there wif him but Barnaby is a camera hog.
Since Barnaby and Boomer are rescue doggies it seems appropriate that I
allow them in the same vehicle wif me.
